Privacy Policy

How CognitiveMedia (“we,” “us”) collects, uses, and protects your information.

The short version

We collect what we need to run CognitiveMedia, we protect it, and we don't sell your personal information — and have no plans to. If that ever changed, we would only ever share data in de-identified, aggregated form under strict safeguards, we would update this policy first, and California residents would always be able to opt out as the law provides.

1. Information we collect

Account information. Email address, display name, and authentication identifiers when you create an account or sign in with a third-party provider.

Conversation data. When you talk to an avatar we process your voice and text in real time to generate responses. Transcripts and session metadata (duration, timestamps, the avatar involved) are stored so account owners can review their usage. If an avatar has memory enabled, short factual notes you choose to share (a name, a preference, a goal) may be saved so the avatar can remember you across conversations — you can view and delete these at any time.

Usage and billing data. Minutes used, plan and subscription status, and payment records. Card details are processed by Stripe and never touch our servers.

Technical data. IP address, browser type, and device information used for security, rate limiting, and abuse prevention.

Optional location. Some avatars are limited to a physical location; if you choose to talk to one, your browser will ask for your location and we use it only for that access check.

2. How we use information

To provide and improve the service; to power avatar conversations through our AI infrastructure partners (such as Anam.ai for real-time avatars and LLM providers for language understanding); to bill subscriptions through Stripe; to keep the platform secure; to respond to support requests; and to comply with law.

We do not use your private conversations to advertise to you, and we do not sell or share your personal information for cross-context behavioral advertising as defined by the CCPA/CPRA.

3. Sharing and disclosure

We share personal information only with: (a) service providers who process it on our behalf under contract (hosting, AI avatar rendering, speech processing, payments, email delivery); (b) avatar owners, who can see transcripts and usage for conversations held with their own avatars; (c) authorities when legally required; and (d) a successor entity in a merger or acquisition, under this policy's protections.

While we do not intend to sell customer data, we reserve the right to share anonymized, aggregated, or de-identified information — data that can no longer reasonably identify you — for analytics, research, or commercial purposes. We commit to maintaining and not re-identifying de-identified data, as required by California law.

4. Your California privacy rights (CCPA/CPRA)

If you are a California resident, you have the right to: know what personal information we collect and how it's used; access a copy of it; correct inaccurate information; delete it (subject to legal exceptions); opt out of any sale or sharing of personal information (we currently do neither); limit use of sensitive personal information; and to not be discriminated against for exercising these rights.

To exercise any right, email support@cognitivemedia.ai or, if you're a customer, open a support ticket from the Contact page. We verify requests against your account and respond within the timelines the CCPA requires (generally 45 days). You may use an authorized agent; we'll verify their authority.

5. Retention

We keep personal information only as long as needed for the purposes above: account data for the life of your account, transcripts and memories until you or the avatar owner deletes them or the account closes, and billing records as required by tax and accounting law. When you delete your account, we delete or de-identify your personal information within 30 days, except where retention is legally required.

6. Security

Data is encrypted in transit and at rest. Access is restricted by row-level security so each account can only reach its own records. No system is perfectly secure, but we treat your conversations with the sensitivity they deserve.

7. Text messaging (SMS) consent

If you opt in to CognitiveMedia text updates, we collect and store your phone number, the time of your consent, and how it was given (web form, verbal consent to an avatar, or staff-recorded). We use this only to send the messages described at enrollment — demo reminders, booking confirmations, account activity, and occasional offers, up to 4 messages per month.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, excluding the messaging providers that deliver texts on our behalf. You can opt out at any time by replying STOP to any message.

8. Children

CognitiveMedia is not directed to children under 13, and we do not knowingly collect personal information from them. Avatars built for educational audiences are operated by their account owners, who are responsible for obtaining any consents their use requires.

9. Changes and contact
